Also thinking of selling my bike. I just don't get to ride it as much as I'd like now that the kids are all in sports or this and that.

Motorcycle = true ride freedom.

(Seriously though, good shit man.)
Title: Re: I got my License!!!

Technically speaking. In the United States you do not have to have a license to drive a passenger vehicle. Its a right not a law, and it's protected by the constitution.

But the catch is, since you know this isn't advertised because the state would lose money, it's null and void if you've ever had a license. Once registered as a driver in any state you have to ha e a license till you die or are deemed not eligible to drive by the state.

Normally I'd say something like "stupid Americans" right around here but honestly, I way prefer that approached. 100% of the driver's Ed and schooling and time we go through is pure bullshit, as is the amount of money you need to pay for your license.

Wait, Really? Where in the constitution does it say you have the right to drive a car?

That would be tough, since cars weren't invented.

(Not trying to start a fight, genuinely curious)

Oh, it's one of those things like where ppl think they don't have to pay income tax.

"Right to travel" does not equal "state can't pass a law requiring a license to operate a motor vehicle."

Miller v Reed 1999 "there is no 'fundamental right to drive'l

Mathew v Honish 2007 "without vehicle licenses, Dean is denied only “a single mode of transportation-in a car driven by himself,” see Miller, 176 F.3d at 1204, and this does not impermissibly burden his right to travel."
Title: Re: I got my License!!!

Every citizen has the right to personal transportation and to move freely within the country. Privileges and immunities clause.

Ref: Crandall Vs. Nevada (1860); The United States Vs. Wheeler (1920); United States v. Guest, 383 U.S. 745 (1966).

And several more supreme court rulings.

Again the catch is: once you register as an operator you lose the privilege of freedom of movement.

Not at all bud. I have several Agorist friends in my circle who have never filed for a license and use this everyday of their lives.

My references are newer. XD

But, if you have friends who have been detained / ticketed for operating a vehicle without a license, and they successfully had the charges dismissed, I suppose you must be right.

Only one of them has ever been detained for operating without a license, and that was in Rhode Island where cops are just primal savages to begin with. He was released within an hour.

Now yeah States can pass a law, but it doesn't mean that law is legal and has to be upheld.

Personal opinion: Law is evil by definition.
Title: Re: I got my License!!!
Post by: Sethaniel on February 24, 2016, 07:52:13 pm
Crandall v Nevada establishes that a state cannot prevent a person from leaving the state by taxing them.

United States v wheeler was a kidnapping case which established that the constitution grants states, and not the federal government, the right to prosecute individuals for interference with the lawful right to travel.

United States v Guest extends the protection of the 14th Amendment to citizens who suffer rights deprivations at the hands of private conspiracies, where there is minimal state participation in the conspiracy.

Sorry.  I have a pathological need to research things.

Title: Re: I got my License!!!
Post by: Sethaniel on February 24, 2016, 07:56:30 pm
So, none of those cases is actually about whether or not the state can require you to have a license to operate a motor vehicle.  But I bet you can find sentences within the decisions that could be quoted to support that position.
Title: Re: I got my License!!!
Post by: Aeon_spiral on February 24, 2016, 07:57:38 pm
lol dude im not mad at you. I want people to research things its my goal in life

Crandall Vs. Nevada came about by taxing passengers, which brought about the freedom of movement for passenger vehicles (IE: No tax = modern terms Fee for registering a motor vehicle and obtaining license for operating)

https://supreme.justia.com/cases/federal/us/73/35/case.html (https://supreme.justia.com/cases/federal/us/73/35/case.html)

XD

Laws are how us weak people keep down you Nietzschean supermen.

Crandall establishes a fundamental right to travel, but it does so in the context of "can Nevada pass a law imposing a tax on all passengers leaving the state?"

Specifically, they're concerned with whether passengers are equivalent to goods and therefore potentially subject to import/export fees.

There's no mention whatsoever of a right to operate a vehicle.  In fact, they're explicitly discussing passengers.

So, on Aeon's conspiracy theory about the "constitutional right to drive"...

You can drive a car without a license, registration, insurance, etc, on your own property.

The States have a right to regulate who travels on the roads they maintain and on public property.

Theoretically, if every private land owner let you travel across their property, you could go from point A to point B without traversing State owned property, thus legally driving without the need for any of the above.

But that's not going to happen anywhere a sane person actually wants to drive.

seems like dealing with an LEO in general would you get you tazed, or shot, or your dog shot, or your innocent child shot. I carry a gun because law enforcement doesn't travel at 1400 FPS, and even if they did you have a better chance of dying by calling them than dealing with your problem by yourself.

I tell my children never to speak to LEO for any reason, they need to call me first. They're not your friend, they're not your hero. They are extortionist hired for the sole purpose of generating revenue for the state by any means necessary.

Wouldn't say they're evil necessarily. I believe they have a warped sense of justice and morality, certainly, but not evil. Well, not most of them at least, but evil people would certainly gravitate towards a position with the power and social status that comes with being a cop.

Would I say the majority of them are dirty, power hungry try hards? Most certainly, but I'm on good terms with a lot of cops. One actually let me out of the car for a little bit while he was taking me to county so we could smoke a cigarette. Granted, I was in cuffs the entire time, but it was nice of him and he actually could've gotten in trouble for it.

I've also had an officer pull their gun on me multiple times, most of which were unnecessary. First time I was 14 years old, and his partner got hit by a car chasing my buddy when he ran off. He kicked my other friend's leg out from him and slammed him into the pavement when he said he didn't consent to a search, then bragged about piledriving him (again, he kicked his leg out from under him) after the fact.

My friend was only 12 years old at the time.

So yeah, some cops can be cool, and others can be awful, but most of them are just dicks with control issues.

Errr, I hate when people call them that, haha. I can understand the reasoning, but in my opinion its like equating Donald trump to Hitler because of some certain similarities.

I mean yeah they're bad, and they've got their issues, but life is better just cause they exist. I mean, I know better than to get police involved with my business, but they still have a certain degree of culpability, especially with cell phones and social media nowadays.

Gangs are just evil. MotherFarkers go out and kill people just for living a few streets in the wrong direction or wearing the wrong color. I think 4 or 5 toddlers got killed on the east side last year cause of gang violence, not to mention all the people who got robbed, raped, or killed. Those dudes sling drugs and shoot guns for a living, they're not exactly a necessary evil.

I think its pretty safe to assume you're virtually never on the wrong side of the law, so I wouldn't expect you to understand. Not a jab or anything, and its cool that you've got police looking out for you given how shitty this world can to be to certain ethnicities at times, its just they tend to act like supercop justicedick whenever they're on call.

I'm from the suburbs myself, but I spend the majority of my time in Cleveland, even though i haven't lived there for a few years now. Suburban cops can be pretty chill, especially the older guys, but they get power drunk just like anybody would if given a badge and a gun.

City cops are pieces of shit. Fark em, period. I don't know how many times I've gotten pulled over just cause I was walking through a black neighborhood and they figured I was there for drugs.

I have a general distrust of authority, and while I think cops are given more shit than they deserve, I still think they should all wear body cams. For accountability, and because I imagine it'd be a great way to deescalated situations quickly, so both sides win in the end.

Dude, I'm just talking about Cleveland. I can't even imagine how many kids got killed across the country cause of gangs. Have you ever seen an eight year old kid with their brains blown out on the street corner with his mom crying on top of him all because some guy couldn't shoot straight? Because that shit happens all the time out here. I know you're from a different county, but you've had to spent at least a little time in some of the projects up here.

The cops aren't a gang, they're just a group of punks with control issues. The majority of them don't sell drugs, rape people, or murder human beings over money. Yeah, the accountability system is Farked, but its a flawed system that needs to be improved, gangs will never get better for as long as they exist. The Farked up things those gangs do are partially responsible for the way cops treat people, why do you think Tamir Rice got killed?

The hood isn't a joke, and that shit isn't sweet, that's why I don't really Fark with that life anymore. Too many people get killed or hooked on drugs, and its too Farked up.

Tldr, cops are bad, gangs are worse.

Most definitely. False claims of police brutality can by dismissed quickly with actual evidence, and cops can actually be found accountable for their own actions. Plus, people are usually nicer when they know they're being recorded.

Cop has his camera off during a shooting or otherwise physical confrontation? Terminated.

Yeah, that may be the key deciding factor in determining if body cams work. Police have to be held accountable if video is misplaced, tampered with, not handed in, etc. The cams mean nothing if the public can't trust that the videos will actually be there, or that the cops can get around them.

Some of those have pretty sensationalist headlines.

"NY police accidentally shoot shop worker to death" - Someone ran (physically) into a cop after fleeing from a store being robbed. Force of impact caused the officer to shoot the guy in the shoulder, once. Officer already had the gun out because they knew the store was being robbed. He later died in hospital.

Bias aside, it has a lot of incidents. What a shitty way to go though. Escape an armed robbery only to literally run into a gun and die.
